Welcome to PeachAI (“we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the PeachAI mobile application (the “App”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old to use PeachAI. By using the App, you represent and warrant that you meet this requirement.

2. Description of Service

PeachAI provides AI-powered tools that allow users to:

• Convert photos into videos

• Enhance and edit images

• Apply visual styles and transformations

All outputs are generated automatically based on user-provided images.

3. User Content

3.1 Ownership

You retain ownership of any content you upload (“User Content”).

3.2 License to Use

By uploading content, you grant PeachAI a limited, non-exclusive, non-transferable license to:

• Process your content

• Generate requested outputs

• Provide app functionality

This license is used solely for delivering the service.

3.3 User Responsibility

You agree that:

• You have the necessary rights and permissions to upload content

• Your content does not violate any laws or third-party rights

• You will not upload harmful, illegal, or abusive material

4. Facial Data and AI Usage

PeachAI processes facial images only when voluntarily provided by users and strictly for feature functionality.

We do not:

• Perform facial recognition or identity verification

• Use facial data for model training

• Share facial data with third-party AI services

5. Subscriptions and In-App Purchases

5.1 Billing

• Some features may require payment via in-app purchases or subscriptions

• Payments are processed through Apple’s App Store

5.2 Auto-Renewal

• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period

5.3 Management

• You can manage or cancel subscriptions in your Apple account settings

6. Acceptable Use

You agree not to:

• Use the App for illegal or harmful purposes

• Attempt to reverse engineer or exploit the App

• Upload content that infringes privacy, copyright, or other rights

• Misuse AI-generated content in a deceptive or harmful way

7. Intellectual Property

All rights in the App, including software, design, and technology, are owned by PeachAI or its licensors.

You may not copy, modify, distribute, or create derivative works without permission.

8. Service Availability

We may:

• Modify, suspend, or discontinue the App at any time

• Update features without prior notice

We do not guarantee uninterrupted or error-free operation.

9. Disclaimer of Warranties

The App is provided “as is” and “as available.”

We make no warranties regarding:

• Accuracy of generated content

• Reliability or availability of the service

• Fitness for a particular purpose

10. Limitation of Liability

To the fullest extent permitted by law, PeachAI shall not be liable for:

• Indirect or consequential damages

• Loss of data, revenue, or profits

• Issues arising from user-generated content

11. Termination

We reserve the right to suspend or terminate access if:

• You violate these Terms

• Your use poses risk to the App or others

12. Privacy

Your use of the App is also governed by our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by applicable laws of your jurisdiction, without regard to conflict of law principles.
